Cadence Terms

These terms are an agreement between you and Making Things For Smiles, LLC, which operates Cadence. By creating an account, posting, applying, accepting a booking, or paying through Cadence, you agree to these terms and the Privacy Policy.

Cadence is an online aggregator for human running-pacing services. Individuals, teams and clubs, and race organizers can post pacing needs; pacers can publish offers and apply.

Eligibility and accounts

You must be at least 18, provide accurate information, keep your account secure, and use only organizations and records you are authorized to represent. Cadence may limit or close accounts used for fraud, harassment, unsafe conduct, impersonation, payment abuse, or material violations of these terms.

Listings, applications, and bookings

A listing is an invitation to discuss a possible pacing arrangement, not a guaranteed match. Each party must review the pace, distance, date, route or event, meeting details, compensation, and other expectations before accepting.

When a listing owner accepts an application, Cadence creates a booking using the amount both sides can see. A paid booking is confirmed only after Stripe reports successful payment. Browser confirmations, screenshots, messages, and budget fields are not proof of payment.

Payments, 15% fee, and payouts

Paid bookings use Stripe Checkout and Stripe Connect. The buyer pays the total shown at checkout. Cadence retains 15% of that total and allocates 85% to the pacer. For an $85 booking, Cadence keeps $12.75 and the pacer receives $72.25. Cadence bears ordinary Stripe processing fees from its share; refunds, disputes, taxes, and legally required adjustments may change the final net amount.

Pacers must complete Stripe identity and payout onboarding. Stripe and financial institutions control verification, availability, holds, and payout timing. Cadence may delay or reverse a payout when reasonably necessary for a refund, chargeback, fraud review, sanctions screening, legal obligation, or account restriction.

The Cancellation Policy applies to paid bookings and is accepted at checkout. Attempting to avoid the agreed fee by moving an accepted Cadence booking off-platform may result in account restrictions.

Pacer and organization responsibilities

Pacers choose whether, when, and how to offer pacing and are responsible for their own training, equipment, transportation, insurance, licenses or permits if required, tax records, and taxes. Cadence does not withhold payroll taxes or promise any minimum amount of work.

Cadence does not control the manner and means of a pacing service. The parties intend an independent service arrangement, but that label does not override employment, worker-classification, tax, or other laws that apply to the actual facts. Teams, clubs, schools, coaches, and race organizations remain responsible for their own classification and reporting duties.

Safety, health, and event authorization

Running and pacing involve physical exertion, traffic, weather, terrain, crowds, and other risks. You are responsible for your health, training readiness, route choices, emergency planning, and decision to participate. Cadence is not medical advice and does not guarantee a finish time, performance, or safe outcome.

Follow all race, venue, school, club, permit, insurance, and organizer rules. A listing does not mean that an event permits outside pacers, bib sharing, course access, commercial activity, or payment. Users representing an organization must have authority to post and book on its behalf.

Cadence's marketplace role

Cadence provides discovery, communication, booking records, and payment tools. Cadence is not the race organizer, coach, medical provider, insurer, employer, employment agency, or guarantor of a user. Profile information, connected fitness records, reviews, and labels can be incomplete or outdated and are not background checks or professional certifications.

Content and acceptable use

You keep ownership of content you submit and give Cadence a limited license to host, process, display, and distribute it to operate and promote the marketplace. Do not submit unlawful, deceptive, infringing, discriminatory, threatening, sexually exploitative, privacy-invasive, or unauthorized content; scrape the service; interfere with security; manipulate reviews; misuse payment disputes; or use another person's fitness or identity records without permission.

Disclaimers and limits

Cadence is provided on an as-available basis. To the fullest extent allowed by law, Cadence disclaims implied warranties and is not liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, lost opportunities, or a user's conduct.

To the fullest extent allowed by law, Cadence's aggregate liability arising from a claim is limited to the greater of $100 or the Cadence fees you paid for the booking giving rise to the claim. Nothing here limits rights or liability that cannot legally be limited, including applicable consumer-protection rights.

Governing law, contact, and changes

Wisconsin law governs these terms, without overriding mandatory consumer protections that apply where you live. Courts with jurisdiction in Wisconsin may hear disputes. Questions or legal notices can be sent to mark@makingthingsforsmiles.com. Material changes will be posted with a new effective date and may require renewed acceptance. The Safety Guidelines are incorporated into these terms.
